A patent is the grant of a property right to the inventor, issued by the Mexican
State. The right of a patent is the right to exclude others from making, using,
offering for sale, or selling the invention, basically, a patent gives the owner
the right to a monopoly on the use and sell of the invention for a period of
time. The term of a new patent in Mexico is usually 20 years from the date on
which the application for the patent was filed.

In Mexico an inventor may patent an invention that must be new, useful, and non-obvious.
• The invention must be result of a creative process whose results are not
deduced in evident form. (non-obvious)
• The invention must have some industrial application and may be used in any
branch of the economic activity. (useful)
Do you know what are the terms to file a patent request?
The recommendation is that the request is filed before the invention is
presented to the public, which usually occurs when commercializing the
respective product.
However, the Mexican law grants the term of 1 year, so that the request can
validly be presented.
